Terms & Conditions – Hayman Island Promotion
1. Information on how to enter form part of these terms and conditions.
2. Entry into the competition is deemed to be acceptance of these terms and conditions.
3. To be eligible to enter this competition, entrants must:
(a) be permanent residents of Australia who are not employees or contractors of Carruthers Financial Services Pty Ltd (CFS) or Business Flair (BF) a trading entity of CFS, immediate family members of employees or contractors of the company;
(b) be over the age of 18 and be a NSW Resident;
(c) Must lodge a loan application via Carruthers Financial Services Pty Ltd or Business Flair for either a home loan, Business Loan or Development Finance to a value of $100,000 or greater within the promotion period. The loan must be unconditionally approved by the lender of their choice within 10 business days of application. Applicant’s loans that are not approved by the lenders will not be entered into the drawn. Each Applicant will be provided with two entries into the draw at time of unconditional approval.
(d) People or businesses that refer home loans, Business Loans or Development Finance to CFS, and the referred applicant loan proceeds to unconditional approval, as per clause (c) above, will receive one entry into the competition.
4. The competition commences at 12am on Monday 11th November 2008 and concludes at 12pm on Friday 27th of February 2009 (“the Promotional Period”).
5. Each entrant is permitted to enter the competition more than once.
6. You may not submit an entry on behalf of someone else. You may only submit an entry for yourself.
7. There will be 1 prize and 1 winner. The prize consists of
“5 Nights on Hayman, Australia’s leading Resort. Situated within the Great Barrier Reef, Hayman offers a genuine island experience of natural beauty, privacy, tranquility and adventure.
Your Hayman experience includes five (5) nights for two people in a beautiful Lagoon Deluxe Room, daily buffet breakfast in Azure overlooking the coral sea. Return luxury cruiser transfers between Great Barrier Reef Airport (Hamilton Island) and Hayman and use of the non-motorised watercraft, fitness facilities and the activities centre.
AS transfers are included with this prize, we ask you to ensure that your airline tickets are to Great Barrier Reef Airport (Hamilton Island) and present your airline luggage tickets to the Hayman representative at the airport upon arrival”
The Prize must be taken before the 30th June 2009 otherwise the gift voucher will expire.
Please Note that the following is not included in the prize:-
Airline tickets or other transportation costs and all taxes involved with travelling to Great Barrier Reef Airport (Hamilton Island).
Transfers to & from your Residence to your airport of choice or Great Barrier Reef Airport.
Travel Insurance is not included in the prize. Travel insurance is recommended to be taken at your own expense.
8. The winner will be by randomly drawn from eligible entries at 5pm on Friday 6th of March 2009 at the CFS Head office.
9. The first entry randomly drawn from eligible entries will be the winner.
10. The winner will be notified by telephone and email (if provided). Their name and suburb will be published on our website.
11. CFS may also use the winners’ names and suburb in promotions and announcements in any of CFS media releases.
12. The judges' decision is final and no correspondence will be entered into.
13. The prize is not exchangeable or transferable and cannot be redeemed for cash. Any additional expenses incurred by the prize-winner, other than those outlined in these terms and conditions, are the responsibility of the winner. The prize winner is responsible for all items of a personal nature including but not limited to other meals, phone calls, drinks and spending money etc.
14. CFS accepts no responsibility for any variation in the value of the prize or any variation in the prize advertised and prize provided.
15. CFS makes no representations or warranties as to the quality, suitability or merchantability of the prize. To the extent permitted by law, CFS is not liable for any loss or damage whatsoever which is suffered (including, but not limited to, direct or consequential loss) or for any personal injury suffered or death sustained in connection with entry into the competition or acceptance of the prize. This paragraph is not intended to exclude any liability, which cannot be excluded under Australian consumer protection laws. Any such liability is limited to the resupply of the prize.
16. In the case of the intervention of any outside agent or event which naturally changes the result or prevents or hinders it’s determination, including but not limited to vandalism, power failures, tempests, natural disasters, acts of God, civil unrest, strikes; CFS may in its absolute discretion cancel the event.
